Objective

The Regulation establishes a harmonised airspace classification to be applied above flight level FL195 and lays down harmonised requirements for access of flights operated under visual flight rules to this airspace.

Summary

This Regulation is adopted by the European Commission pursuant to the requirement for “a progressive harmonisation of airspace classification, designed to ensure the seamless provision of air navigation services within the framework of the Single European Sky” layed down in Article 4 of the Airspace regulation.

Scope

The Regulation applies to the airspace within the International Civil Aviation Organisation European (ICAO EUR) and African (ICAO AFI) regions where EU Member States are responsible for the provision of air traffic services (ATS).

Airspace Classification Above FL 195

All airspace above FL195 shall be classified as Class C airspace, consistent with the provisions of Chapter 2, paragraph 6 of Annex 11 - Air Traffic Services to the Chicago Convention on International Civil Aviation.

Both IFR and VFR flights shall be permitted to operate in the Class C airspace and shall be provided with an air traffic control (ATC) service. IFR flights shall be separated from other IFR flights and from VFR flights.

VFR flights shall be separated from IFR flights and shall receive traffic information in respect of other VFR flights.

Access of VFR Flights Above FL 195

VFR flights may be authorised in the airspace above FL195, up to and including FL285, by the responsible ATS unit in accordance with the procedures established and published by the respective Member State in the relevant aeronautical information publication (AIP).

Where practical, a Member State may establish airspace reservations in the airspace above FL195, in which VFR flights may be allowed.
